- Brokerage and Reservation Contract:
LMWH brokered and reserves packages deals and hotel information by offerers in the name of the customer/guest and arranges or generates the booking in the name of the customer via the booking tool on the website www.lmwh.de. The booking is not valid until the customer has received a written confirmation by the offerer or a direct confirmation by the booking tool via e-mail. LMWH is not a travel agency in terms of §§ 651a ff BGB nor partner of the travel or accommodation contract. The latter is being contracted between the guest and the service provider (e.g. Hotel).
- Liability:
LMWH is not liable for the data, information and services of the offerers. LMWH is not liable for defects of the respective accommodations or for the therefore linked services. LMWH is only liable for the brokerage operations; the liability is limited to malice and intent or gross negligence exclusively.
- Brokerage and Reservation Fee:
For the brokerage and the reservation no expenses are incurred for the customer. LMWH receives a brokerage fee (commission) from the offerer. The commission will be regulated separately with the offerer in the brokerage contract.
- Conditions of Payment:
The costs for the arrangement or for the overnight stay must be payed to the hotel directly. The final price of the booked service as well as payment terms are normally declared on the booking confirmation. Spa tax is only included in the price if it is exclusively declared.
- Changes /Cancellations:
Changes or cancellations of bookings, which have been executed by the guest through LMWH, must be shown to the offerer strictly. Concerning possible cancellation fees the terms and conditions of the booked hotel apply.
- Rebooking:
LMWH takes on rebooking whishes from the guest and passes them on to the offerer or the guest must make the rebooking herself/himself by the offerer. It is expressly declared that in general rule a rebooking is a cancellation and therefore includes a cancellation of the contract with the service offerer. Therefore the service offerer is rightfully entitled to charge the cancellation fee. It is recommended to take out a travel-rescission-insurance.
- Quality assurance:
LMWH reserves itself the right to inspect the services/offers of the service providers. LMWH has the right to refuse the brokerage of service/offers of negative quality. In case that damage or loss of quality is detected in already engaged service/offers LMWH is rightfully entitled to take the service/offers out of the brokerage catalogue.
